Recognition of guide's professional qualification for the purpose of establishment in the Republic of Lithuania

EU Member States, European Economic Area States, Swiss Confederation, third countries citizens who have the right to move within Member States under EU law, have the right to apply to the National Consumer Rights Protection Authority (hereinafter – SCRPA) to be recognized as a guide qualification which was acquired in another Member State or outside European Union, European Economic Area and Swiss Confederation.

 

Recognition of the professional qualification of a guide allows to work as the guide in the Republic of Lithuania.

 

The applicant or his / her representative must submit an application to the SCRPA. The application shall be accompanied by the following documents (or a certified copy):

 

1) a document proving nationality;

2) a document stating that the European Union legislation grants the applicant the right to move within the Member States (applicable to third-country citizens);

3) evidence of formal qualifications;

4) document (s) attesting the duration and content of the guide courses and / or training;

5) document (s) related to the qualification of a guide (if there are any);

6) documents (if there are any) of recognition in the Member State of an evidence of formal qualifications obtained in a third country;

7) documents certifying guide‘s professional experience and duration (if there are any);

8) other supporting documents (if there are any) certifying the professional qualifications of the guide;

9) documents confirming the change of the surname (name) (if there are any);

10) a document stating that the person has pursued for one year the profession of guide during the last ten years in another Member State which does not regulate that profession, where the applicant holds one or more evidence of formal qualifications;

11) power of Attorney, if the application is filled by an authorized person.

 

The application shall be accompanied by a translation into Lithuanian of the documents referred to in points 3 to 8 and 10. The translation must be certified by the signature of the translator who translated the documents and / or stamped by the translation agency.

The Commission for the Recognition of the Professional Qualifications of a Guide (hereinafter - "the Commission") shall acknowledge receipt of the application in writing or by electronic means and, where appropriate, notify the applicant or his / her authorized representative of the missing documents within 5 working days of the date of receipt of the application.

 

The SCRPA may, after receiving the Commission's opinion, take the following decisions:

1) recognize the applicant's professional qualifications;

2) refuse to recognize the applicant's professional qualifications;

3) to offer the applicant the choice of a compensatory measure, either an professional aptitude test or a period of professional adaptation.

 

Individuals, whose professional qualification as a guide is recognized and who provide guide services in the Lithuanian language, must be proficient in Lithuanian at least the second state language proficiency category as described in the Description of the State Language proficiency categories and their application procedures approved by the Resolution No. 1688 of the Government of the Republic of Lithuania on 2003 December 24 "On the approval of the description of the State language proficiency categories and their procedures", and to submit a completed form approved by the competent authority. 

 

The final reasoned decision on the recognition of the professional qualifications of a guide shall be taken as soon as possible, but not later than within 3 months of receipt of all relevant documents.

 

The recognition service is for free.

 

Upon recognition of the applicant's professional qualifications, the applicant shall be issued with a guide certificate. The issuance of a guide certificate is subject to a state fee of €18.

The decision on the applicant's recognition or lack of professional qualifications, the granting of a compensatory measure or the rejection of the application may be appealed under the procedure and within the time limits established by the Law on the Recognition of regulated professional qualifications of the Republic of Lithuania and the Law on Administrative Proceedings of the Republic of Lithuania.

 

The procedure for recognition of the professional qualification of a guide is carried out in accordance with Article 28 (6) of the Law on Tourism, the Law on the recognition of professional qualifications regulated in the Republic of Lithuania and Description of the procedure for recognition of the professional qualification of a guide for the pursuit of the guiding profession or for the temporary and occasional provision of guide services in the Republic of Lithuania approved by Order No. 4-149 of the Minister of Economy and Innovation of the Republic of Lithuania on March 7, 2019.
